Bosnian Court Affirms Legality of Displaying Historic Republic of BiH Flag

Displaying the flag of the Republic of Bosnia and Herzegovina (RBiH), featuring the golden lilies, does not constitute a criminal offense or hate speech, a Bosnian court has concluded. This ruling stems from a 2018 first-instance verdict in the Tokić and Bajrić case, which was subsequently affirmed by a second-instance decision in 2020 involving Bajrić and Tokić.

The court's judgment explicitly stated that the RBiH flag served as the lawful and legitimate emblem of an internationally recognized Bosnian state. It was under this very banner that Bosnia and Herzegovina gained admission to the United Nations on May 22, 1992, and subsequently represented the nation in various international forums.

Known colloquially as the "Ljiljanka," the 1992 RBiH flag is widely seen as a symbol of restored historical continuity for Bosnia. For many citizens, the lily emblem embodies the enduring statehood of Bosnia, represents the internationally recognized Republic of Bosnia and Herzegovina, and signifies the resilience of a nation defended by the Army of RBiH during the war.

Furthermore, the use and display of the Army of RBiH flag are also not constitutionally or legally prohibited. The lilies themselves boast a centuries-old lineage within Bosnian history, tracing their origins back to medieval Bosnia, the Kotromanić dynasty, and the heraldry of King Tvrtko.

Adnan Bajrić, one of the individuals involved in the court cases, shared on his Facebook profile that his flag was returned to him following the acquittal. He encouraged citizens of Bosnia and Herzegovina – including Bosniaks, Serbs, Croats, Jews, and others in the homeland, Sandžak, and the diaspora, as well as supporters of Bosnian national teams like the "Ljuti Krajišnici" and "BHFanaticosi" – to proudly display the flags and show their support, noting that the "spirit of the lilies" is spreading. Bajrić also highlighted the upcoming observance of May 22, a historic day commemorating the RBiH's admission to the United Nations, which will again be celebrated with the "Ljiljani" flags throughout the country.
